Terms and conditions

 

The contractual terms and conditions will apply to all sales of goods and services carried out by Norvic Ama SRL, through the virtual store www.incalzire-perfecta.ro to buyers, individuals or legal entities. We reserve the right to make changes without prior notice.

Use of this site constitutes acceptance of these terms and conditions.

  1. Definitions:

- Seller – the commercial company Norvic Ama SRL, with registered office in Stefanestii de Jos commune, str. Padurii, no. 1, block A1, floor 2, apartment 201, room 1, Ilfov county, identified with CUI 38171199 and J23/4539/2017. Goal. 0749 233 233 email: norvic.ama@gmail.com

- Buyer - any natural or legal person who issues an order

- Order – electronic document that intervenes as a form of communication between the Seller and the Buyer through which the Seller agrees to deliver the Goods and Services and the Buyer undertakes to receive these Goods and Services and to pay for them.

- Goods and Services - any product or service, including the documents and services mentioned in the Order, to be provided by the Seller to the Buyer.

- Specifications - all the specifications and/or descriptions of the Goods, as specified in the Order.

  1. Information about Goods and Services

The information presented on the seller's website is informative and can be modified by the seller without prior notice. Also, for reasons related to space and the coherence of the information structure, product descriptions may be incomplete, but the seller makes efforts to present the most relevant information, so that the product is used within the parameters for which it was purchased;

  1. Price, Billing, Payment

The Seller will issue to the Buyer an invoice for the Goods and Services that will be delivered, the Buyer's obligation being to provide all the information necessary to issue the invoice in accordance with the legislation in force and to pay the price.

Payment methods:

A. Cash refund

The value of the ordered products will be paid in cash upon receipt of the package from the courier.

B. Payment by card

The value of the ordered products will be paid with the online card.

C. By bank transfer

After confirming the order, a proforma invoice will be issued and sent to the buyer by email. The identification data of the Seller will be written on the proforma invoice, including the account and the bank for making the payment. For orders with payment by bank transfer, the delivery term is calculated starting with the date of receipt of the amounts in the Seller's account.

  1. Delivery

The seller will deliver the goods to the buyer in a fast courier system through the following partners: Fan Courier, Nemo Expres, Sameday.

Transport is FREE OF CHARGE for the products: Radiant panels / Tagu electric fireplaces / Prana heat recovery ventilation systems, only for addresses in the Fan Courier delivery area.

For other products, shipping costs 29 Ron.

The delivery time is 1-3 working days from the moment the order is confirmed (For localities where the courier company does not have headquarters, the delivery time can be extended up to 5 working days). The day of the order, Saturdays and Sundays and legal holidays are not calculated.

The seller will ensure the appropriate packaging of the goods and will send the accompanying documents together with the products (invoice, guarantees, certificate of conformity, instructions, etc.)

Unless otherwise agreed by the Seller and the Buyer, the Seller discharges the risks and responsibilities associated with the Goods and Services at the time of their delivery to the courier company or to the Buyer's representative.

If at the time of delivery the package is seriously damaged, you must take pictures and the courier must make a damage report, if you accept it without a damage report, the seller is no longer responsible for risks or damages.

  1. Return of Goods

Norvic Ama SRL complies with the provisions of Emergency Ordinance No. 34/2014 regarding consumer rights in distance contracts, which gives the buyer the right to return all purchased products within 14 days of receiving them, without penalties and without citing any reason. According to the provisions of this ordinance, products can only be returned if they are in the same condition in which they were delivered, including the packaging.

Products with signs of wear, with the packaging opened or unsealed, with physical changes, bumps, scratches, etc., are not accepted for return. The right to return, provided for in article 9 of the Emergency Ordinance no. 34 of 2014, exists to allow the buyer to examine the product as they would in a store, not to offer 14 days of free use.

The responsibility and cost of transport for the returned goods falls under the responsibility of the buyer.

SC Norvic Ama SRL will refund the value of the returned goods by bank transfer in no more than 15 working days from their receipt.

  1. GUARANTEES

All the goods sold on the website www.incalzire-perfecta.ro benefit from a guarantee according to the legislation in force and the commercial policies of the producers. The products are new in appropriate packaging.

Warranty certificates are issued either directly by the manufacturer or by Norvic Ama SRL. In the case of certificates issued by Norvic Ama SRL, the defective product must be sent to SC Norvic Ama SRL according to the instructions in that certificate. Shipping costs in this case are borne by the Seller.

  1. Major force

None of the parties will be responsible for non-performance of its contractual obligations, if such non-performance is due to a force majeure event. Force majeure is the unforeseeable event, beyond the control of the parties and which cannot be avoided.

  1. disputes

This contract is subject to Romanian law. Disputes of any kind arising from the execution of the contract will be settled by the parties amicably. If this is not possible, the dispute will be submitted for resolution to the competent courts in Bucharest.

  1. Electrical and electronic equipment waste

Waste electrical and electronic equipment (WEEE) can contain dangerous substances that have a negative impact on the environment and human health if they are not collected selectively.

Considering the provisions of GEO 195/2005 - regarding environmental protection, GEO 78/2000 - regarding the waste regime, based on the provisions of art. 10 of HG 448/2005, regarding the waste of electrical and electronic equipment, customers will consider the following:

- customers have the obligation not to dispose of waste electrical and electronic equipment (WEEE) as unsorted municipal waste and to selectively collect this WEEE;

- the collection of this waste (WEEE) will be carried out through selective collection points made available to producers by the local public administration authorities which have the obligation according to art.5 paragraph 1) of HG 448 /2005 to separately collect WEEE from private households and to make available to producers the necessary spaces for the establishment of WEEE collection points;

- customers can hand over WEEE for free at the specified collection points when purchasing a new product from the same category.

The symbol indicating that electrical and electronic equipment are subject to separate collection is a wheelie bin with two X-shaped lines. This icon indicates that WEEE should not be mixed with household waste and that they are subject to selective collection.

  1. Copyright

Elements and the text of the site's content - Web graphic elements, scripts, logos, icons, images, programs, databases - are the property of SC Norvic Ama SRL and are protected by the law for the protection of copyright. The use without the written consent of Norvic Ama SRL of any elements listed above is punishable according to the laws in force.




PROTECTION OF PERSONAL DATA

The seller reserves the right to store information about website visitors, applicants, buyers, respectively: name, address, email, phone, CNP, ordered products, for the duration necessary to fulfill orders, communicate information about promotions, as well as in order to statistics.

According to the requirements of Law no. 677/2001 for the protection of individuals regarding the processing of personal data and the free circulation of these data, amended and supplemented and of Law no. 506/2004 regarding the processing of personal data and the protection of private life in the electronic communications sector, Norvic Ama SRL has the obligation to administer in safe conditions and only for the specified purposes, the personal data communicated by the Buyer. The recorded information is intended for use by the Seller's operators. The purpose of data collection is: issuing the tax invoice, informing the Buyer about the status of the order and sending him the ordered products.

The Buyer's refusal to provide these data determines the impossibility of making the order.

According to Law no. 677/2001, the Buyer benefits from the right to access, to intervene on the data, to request the deletion of the data from the database, the right not to be subject to an individual decision and the right to go to court.

The seller undertakes not to provide any information (names, addresses, orders, etc.) to third parties with the exception of the courier or post office. The personal data of the customers may be transmitted to the legal authorities to verify the commercial transactions or to other legal authorities to carry out any checks justified by law, if this will be requested in accordance with the laws in force.

It is forbidden to provide false or incomplete data when completing an order, in which case the Seller reserves the right to take legal measures against the persons concerned.

Observation:

*any person has the right to oppose, for legitimate reasons, the processing of data concerning him. This right of opposition can be excluded for certain processing provided by law (e.g.: processing carried out by financial and tax services, police, justice, social security). Therefore, this mention cannot appear if the processing is mandatory;

*any person also has the right to object, free of charge and without any justification, to the processing of their personal data for direct marketing purposes.

The "verbal" mode of information is used, exceptionally, in the situation where it is not possible to provide information in other ways (eg: information through telephone conversations, if they are recorded).

People who access the website www.incalzire-perfecta.ro can make comments, send suggestions, questions or other information, as long as their content is not: illegal, obscene, defamatory, threatening, does not violate intellectual property rights, does not it in no way disturbs the private life of other people, it does not contain viruses. SC Norvic Ama SRL has the right (but not the obligation) to delete any such messages identified on the site.

SC Norvic Ama SRL will not be responsible and will not be liable for any kind of compensation for any kind of damage caused by such communications.
